The evidence that the plaintiff’s attorney provided during the lawsuit included nearly 60 letters from minors to UST. Mr. Ponvert claimed the letters were written by authors who described themselves as adolescent users of smokeless tobacco. In several letters, the teenagers asked UST to not increase the price of the products, so they are affordable to children.
In some cases,[link widoczny dla zalogowanych], the company even sent those children free sample of their products together with the letters back, according to Mr. Ponvert. In 1970s, when these letters were written the sales of tobacco products to minors were not prohibited on any level. Altria denied any comment on the issue, saying that the letters were written prior to the acquisition to Altria that took place last year. Smokeless tobacco products started to carry health warnings in the late 1980s.
These warnings were modified this summer and now include the messages, saying that smokeless tobacco can cause mouth cancer, tooth loss, and is addictive. In a similar case held in the 1980s concerning an adolescent consumer of smokeless tobacco who perished due to mouth cancer, a court ruling was in favor of UST. The settlement has been revealed while tobacco industry attempts to ease off proposed graphic warning labels and markets smokeless tobacco as a less dangerous alternative to smoking cigarettes, Ponvert stated.
New York is falling through in its anti-smoking campaign,[link widoczny dla zalogowanych], according to the annual report conducted by the public health organizations. The given report was titled as, “A Broken Promise to Our Children” and was released by American Heart Association, the Campaign for Tobacco-Free Kids,[link widoczny dla zalogowanych], American Cancer Society and American Lung Association. The state occupies the 18th place in protecting children from tobacco, according to the report. In New York, 14.8 % of high school students smoke, and 24,100 children become regular smokers annually.
The state will gain $2.1 billion from the 1998 tobacco taxes, but will spend only $58.4 million ? 2.6 % of it on smoking cessation programs. If speaking about tobacco manufacturers, they spend $429.6 million annually to promote their products in New York; this is seven times more what the state spends on smoking cessation. “New York is facing exacting budgetary challenges,[link widoczny dla zalogowanych], but a default to fund smoking cessation program would be pound-foolish and cost the state too much.
New York’s leaders should remember that smoking cessation program is a wise investment which saves not only money but lives by decreasing smoking-related health costs,[link widoczny dla zalogowanych],” stated Matthew L. Myers,[link widoczny dla zalogowanych], President of the Campaign for Tobacco-Free Kids.
